Terms of Service
These Terms of Service ("Terms") constitute a legally binding contract between you ("you," "your," or "Athlete") and Gonzo Software LLC ("Company," "we," "us," or "our"), governing your access to and use of the Swoley mobile application, the Swoley web application (located at my.swoley.app), the Swoley marketing website (located at swoley.app), and any related tools or features (collectively, the "Service").
By registering an account or using Swoley, you expressly agree to these Terms. If you do not agree, do not access or use the Service.
WARNING: WEIGHTLIFTING, RESISTANCE TRAINING, AND HIGH-INTENSITY PHYSICAL EXERCISE CARRY INHERENT RISKS OF SERIOUS BODILY INJURY, PERMANENT DISABILITY, MUSCULOSKELETAL TEARS, RHABDOMYOLYSIS, OR DEATH.
Not Medical Advice: Swoley provides mathematical volume telemetry, progressive overload calculations, and AI-generated workout templates. The Service does NOT provide clinical medical, physiotherapy, or diagnostic healthcare advice. All content and telemetry are strictly for informational and self-tracking purposes.
Physician Consultation: You should consult a licensed physician or healthcare professional before beginning any strength training program or lifting maximal weights.
Assumption of Risk: You voluntarily, knowingly, and freely assume all risks associated with your workouts. You agree to release and hold harmless Gonzo Software LLC and its personnel from any liability, injury, or loss resulting from your training.
2. Eligibility & Account Security
You must be at least 13 years old to access Swoley. If you are between 13 and 17 years old, you may only use the Service with the verifiable permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf.
You are responsible for safeguarding your login credentials and for all activities that occur under your account. Promptly notify us at legal@swoley.app if you discover unauthorized access.
3. Swoley Elite Subscriptions, Renewals & Refunds
Freemium Tier: Swoley provides a free tier with core logging and a complimentary quota of AI workout generations. Unlimited AI generation and advanced telemetry require a Swoley Elite subscription.
Auto-Renewal: Subscriptions are billed on a recurring monthly or annual cadence. Subscriptions automatically renew at the end of each billing cycle unless cancelled at least 24 hours prior to renewal.
Payment Providers: Web subscriptions are processed via Stripe. Mobile in-app subscriptions are processed via the Apple App Store or Google Play Store and synced via RevenueCat.
Subscription Cancellation: You may cancel your subscription at any time. Your Elite features remain active through the end of the current billing cycle, after which your account reverts to the freemium tier. Web subscribers may cancel via the Account Settings billing portal; mobile subscribers must cancel in their device's Apple ID or Google Play subscription management settings.
Voluntary Account Deletion & Data Portability: You may permanently terminate and delete your account at any time directly within the application under Settings > Preferences & Profile > Delete Account.
- Automatic Stripe Cancellation: If you maintain an active web subscription billed via Stripe, it is automatically cancelled immediately upon account deletion.
- Mobile Store Subscriptions: Subscriptions billed through Apple App Store or Google Play Store cannot be automatically cancelled by third-party applications due to platform provider restrictions. You must manually cancel your active subscription in your Apple ID or Google Play Store account settings to prevent continued recurring billing.
- Irreversible Data Purge: Account deletion permanently and irreversibly erases all workout history, exercises, sets, personal records, templates, body weight logs, and Better Auth authentication credentials from our active databases.
- Self-Service Data Export: Prior to deleting your account, you can download a complete copy of your training history and metrics at any time by navigating to Settings > Preferences & Profile > Export My Data (ZIP).
Refund Policy: Except where mandated by applicable law, all subscription fees, renewals, and purchases are strictly NON-REFUNDABLE. We do not provide prorated refunds or credits for partially used billing periods.
4. User Content & Leaderboard Fair Play
You retain ownership of your workout logs, custom exercises, comments, and profile avatars. You grant Gonzo Software LLC a worldwide, royalty-free license to store, format, and display your content according to your chosen privacy level (public, friends, or private).
Fair-Play & Anti-Cheating Standards:
- Athletes must record authentic, truthful workout and body weight data.
- Falsifying one-rep maxes, posting impossible biological tonnage, or utilizing bots to manipulate competition leaderboards is strictly prohibited.
- We reserve the right to audit, invalidate, or remove suspicious leaderboard records and immediately terminate offending accounts.
- Automated scraping, reverse engineering telemetry algorithms, and harassing other lifters in comments are strictly prohibited.
5. Intellectual Property Rights
The Swoley name, logo, Obsidian Iron visual theme, mobile and web source code, and telemetry calculation models (including fractional muscle belly distribution matrices and sub-10-rep bounded Epley formulas) are the exclusive intellectual property of Gonzo Software LLC. Athletes receive a limited, revocable, non-transferable license to use the app for personal, non-commercial workout tracking.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GONZO SOFTWARE LLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, REPUTATION, PROFITS, OR PHYSICAL INJURIES ARISING FROM YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF FIFTY DOLLARS ($50.00 USD) OR THE AMOUNT YOU PAID US IN THE PRECEDING 12 MONTHS.
7. Governing Law & Jurisdiction
These Terms and any dispute arising from the Service shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles. You consent to the exclusive jurisdiction and venue of state and federal courts situated in El Paso County, Texas, USA.
